Frivolous applications, an avoidable load on courts

The courts are, no doubt, burdened with loads of case files. Even though, it is the right of the litigant to seek redressal but it is not their right to clog the system. Litigants, through their lawyers, habitually file application after application to delay the proceedings, and some lawyers adopt it as a strategy to delay the cases.

The courts, on their part, accept these applications and push them into the routine process of filing “Replies” followed by “consideration”. Many of these applications eventually do get DISMISSED also, but only after wasting months, sometimes years to reach this stage, delaying the main case. One application is not decided when another one comes in. The main case gets stretched into years of frustration and disappointments.

“Justice delayed is justice denied”. Courts must step in to break this “much strategized filings frivolous filings” misusing the legal process against itself. Expediating will follow as a consequence automatically. What’s your opinion?
