Mutual consent divorce: the six-month gap

How long does a mutual consent divorce take in Gurgaon?

Usually about six months from filing to decree, because the six-month statutory gap between the two motions is the mandatory part. The gap exists so that the couple has time to reconsider and reconcile. Courts can waive it where the separation has already been long, the settlement is complete and there is nothing left to reconcile, and in Gurgaon that request is made at the first motion.

Can the six-month period be waived?

Sometimes. The court may waive it where you have already lived apart for a long time, all terms are settled, and reconciliation is not possible. It is a request, decided case by case, and no lawyer can tell you the answer in advance.
